Terms of sale

1. Who we are

Walker Cladding Ltd, trading as Walker Fabrication, a company registered in Scotland under number SC464874, with its registered office and workshop at Unit 1, 16 Kyle Road, Irvine KA12 8JU. In these terms "we" and "us" mean Walker Cladding Ltd, and "you" means the customer.

2. Quotations

This website does not price anything automatically. Sending an enquiry through it is a request for a quotation, not an order, and no contract is formed and no charge is made by submitting one.

We reply with a written quotation. It is valid for the period stated on it, and only for the specification, quantity and materials it names.

A quotation is based on the information you gave us. If the schedule, drawing or sizes change, the price may change with them.

3. Your design, your responsibility

You are responsible for the accuracy of the file you send us. We manufacture to the geometry supplied, not to what we believe you intended.

You confirm that you own the rights to the design, or have permission to have it made. We do not check designs for third-party rights.

Where we comment on a design, we are telling you whether we can make it on our machines. That is not a review of whether it is fit for your purpose.

4. Custom-made goods and cancellation

Everything we make is manufactured to your specification. Under regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the fourteen-day right to cancel does not apply to goods made to a consumer's specification or clearly personalised.

This means that once manufacture has begun, an order cannot be cancelled for a refund. If you need to change or cancel an order, contact us immediately: before cutting starts we will usually be able to help.

Nothing in this clause affects your rights where goods are faulty, not as described, or not of satisfactory quality.

5. Tolerances

Manufactured parts are supplied within the tolerances published in our design guidelines. A part within those tolerances conforms to the contract.

Where you need a tolerance tighter than those published, tell us before ordering. If we have not agreed a tighter tolerance in writing, the published figures apply.

6. Payment

We do not take payment through this website. All work is invoiced.

Unless we have agreed account terms with you in writing, invoices are payable before collection or despatch.

Prices are quoted excluding VAT unless stated otherwise, and VAT is added where it applies.

7. Lead times and delivery

Lead times are estimates given in good faith and are not guaranteed unless we have agreed a fixed date in writing.

Risk in the goods passes to you on collection or on delivery. Title passes when we have received payment in full.

8. Faults

Check your goods on receipt. Tell us about any shortage, damage or fault within seven days of collection or delivery so that we can inspect it.

Where goods are faulty or do not conform to the agreed specification, we will remake or refund them at our option.

9. Liability

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, our total liability in connection with any order is limited to the price paid for that order, and we are not liable for loss of profit, loss of contract, or any indirect or consequential loss.

We are not liable for the consequences of a design being unsuitable for its intended use, where we have manufactured it as supplied.

10. Governing law

These terms are governed by Scots law, and the courts of Scotland have jurisdiction.
